Failure to comply with this clause may result in a fine of up to $10,000 USD, at the discretion of AZ Pathfinders Inc., doing business as Oasbit.

    YOU AND AZ PATHFINDERS INC., DOING BUSINESS AS OASBIT, AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and AZ Pathfinders Inc., doing business as Oasbit, agree, no arbitrator or judge may consolidate more than one person’s claims or otherwise preside over any form of a representative or class proceeding.

26. Force Majeure

    Neither party shall be held liable for any failure or delay in performing its obligations under these Terms and Conditions due to unforeseen circumstances or events beyond its reasonable control, including but not limited to natural disasters, wars, government actions, or labor disputes (“Force Majeure Event”). The affected party shall promptly notify the other party and make reasonable efforts to resume performance as soon as possible after the Force Majeure Event ceases.
